Dystherapy will act as the data controller for your information. In some cases, other entities within the Dystherapy ecosystem may have access to your information when they perform services on behalf of the data controller (as a data processor) or, where allowed by applicable law, for their own purposes (as a data controller). This may occur for the following purposes:

In these cases, your data will be anonymized, and institutions are prohibited from using your personal information for any purpose other than delivering the relevant services, in accordance with applicable law.
    • Service Providers:
When third-party companies perform services on our behalf, such as handling customer service or delivering packages. These companies are prohibited from using your personal information for purposes other than fulfilling their duties or as required by law.

We understand the importance of providing additional privacy protections for the personal information we may collect from children through our website and mobile applications. When we do collect personal information from children, we take extra precautions to protect their privacy, including:

    Children’s Online Privacy Policy

Dystherapy is committed to safeguarding the privacy of children who use our application. This Children’s Online Privacy Policy outlines our practices concerning information collection, disclosure, and parental consent when dealing with children under the age of 13, in accordance with the U.S. Children’s Online Privacy Protection Act (COPPA).

For more details on how to protect children’s online privacy, please visit OnGuard Online.

    a. The Information We Collect from Children, How We Use It, and How We Communicate with Parents

Dystherapy offers a range of activities for children, including educational games and interactive features. Some activities may involve the collection of personal information from children. Below, we summarize how and when we will notify parents and seek their consent.

    • Registration: Children may register to access certain features of our application. During registration, we may ask for a parent or guardian’s email address, the child’s first name, and other basic information for security purposes. This ensures that only the necessary data is collected to provide the child access to the activity. If a child fails to provide the required information, they may not be able to use certain features of the app.
    • Parent Email Address Collection: In compliance with COPPA, if a child under 13 registers, we will request a parent or guardian’s email address before collecting any additional personal information. If you believe your child has registered without your consent, please contact us at support@edusyntech.com.
    • Content Generated by a Child: Certain activities allow children to create content (e.g., stories, drawings). If the content could potentially include personal information, we will either pre-screen it or seek parental consent before collecting or displaying the content.
    • Parental Consent:
      • Email Consent: We will seek parental consent by email when collecting personal information from children. If parental consent is not received in a reasonable time, we will delete any contact information provided by the child.
      • High-Level Consent: For content that may be publicly shared, we may seek additional forms of parental consent, such as a phone call or a signed consent form.
      • Teacher Consent in Educational Settings: For school-based activities, teachers or school administrators may act on behalf of parents in granting consent for collecting information from children. However, schools are required to notify parents.

    b. Sharing Information Collected from Children

We may share children’s personal information in limited circumstances, such as:

    • With Service Providers: We may share information with service providers who perform business-related functions for us, such as customer support or technology services.
    • Legal Requirements: We may disclose personal information if required by law, such as in response to a subpoena or court order. Additionally, we may share information to protect the safety of children, prevent illegal activities, or protect the integrity of our application.

    c. Parental Choices and Controls

Parents can choose to restrict the collection of personal information from their children or request the deletion of any information we have collected. However, deleting this data may result in the termination of the child’s account or access to certain features.

Parents can manage their child’s personal information by:

    1. Accessing the Child’s Account: Parents can log in to the child’s account to view, change, or delete personal information.
    2. Contacting Support: Parents can contact Dystherapy Support at support@edusyntech.com  to request access, changes, or deletion of their child’s personal information.

    7. Data Security, Integrity, and Retention

Protecting the security, integrity, and confidentiality of your personal information is our top priority. We use a combination of technical, administrative, and physical safeguards to help ensure your data is secure from unauthorized access, misuse, or modification. Our security protocols are regularly reviewed and updated to incorporate advancements in technology and best practices. However, it’s important to note that no system is entirely immune to security breaches.

We retain your personal information only for as long as necessary to meet the purposes outlined in this privacy policy, unless a longer retention period is required or allowed by law.

    8. Data Transfers, Storage, and Global Processing

As a globally operating platform, we may transfer your personal information to Dystherapy’s affiliated entities located in different regions around the world for the purposes outlined in this privacy policy. Regardless of where your personal information is transferred, stored, or processed, we take reasonable precautions to ensure that your privacy is protected.

For data transfers from the European Union, we comply with the applicable legal frameworks, such as adhering to the Safe Harbor Principles set forth by the U.S. Department of Commerce, using European Commission-approved standard contract clauses, or other legal mechanisms to ensure proper safeguards are in place. When necessary, we will also seek your explicit consent. Similarly, we follow the relevant principles for transfers of personal information from Australia.

    9. Fees and Payment

Some of our services are free to use, while others require payment. Additionally, certain services may initially be offered for free but may require payment after a specified period, which may be automatically charged. We will always provide clear details about the payment terms of any paid service before you commit to it, and these terms will be incorporated into this agreement.

When purchasing services like a premium version of the Dystherapy app, you may make your purchase through our App (in app purchase). In addition to our terms, you will also be subject to the terms of the respective app store provider. We may adjust the price or modify the services at our discretion, but if you are already paying for a service, we will notify you in advance if the price or the nature of the service changes. We are not responsible for any losses incurred if you fail to update or cancel a subscription after we have informed you of such changes.

You can pay for certain services (either via our website, within the app, or through an app store) using an auto-renewing subscription. This means your subscription will automatically renew at the end of each subscription period unless you cancel it. If not canceled, you will be charged in advance for the next subscription period. Auto-renewal subscriptions can be modified or canceled by adjusting your settings with the respective app store provider, or if you purchased directly from us, through the app or by contacting us at support@edusyntech.com.

We offer a 2-day refund policy. If you cancel within two days of starting your subscription, you can request a refund through the payment provider. If you cancel after the 2-day refund window, you will not be eligible for a refund for the remaining period of that subscription cycle. For refund requests related to services purchased from our website or app, you can contact us at support@edusyntech.com. If you purchased the services from an app store provider, you must contact the app store directly for refund requests, as we cannot process those refunds.

    10. App Usage Suitability

Our app is suitable for use under the guidance and supervision of family members, parents, and teachers. It is specifically designed with the safety and development of young users in mind. We encourage parents to take an active, supportive role while their children use the app.

    11. Changes to this Privacy Policy

We may update this privacy policy from time to time to reflect new technologies, changes in industry standards, regulatory requirements, or for other reasons. If any changes are significant, we will notify you, and where required by applicable law, we will seek your consent before making those changes effective.

    12. Comments and Questions

If you have any comments or questions regarding this privacy policy, please contact our support team at support@edusyntech.com. Please note that our website and applications may contain links to external sites that are not under our control, and we are not responsible for the privacy practices of those third-party sites. We recommend reviewing the privacy policies of any external websites you visit that may collect your personal information.
